LETSLINK TERMS & CONDITIONS

Welcome to LetsLink! These Terms & Conditions ("Terms") govern your access to and use of the LetsLink mobile application (the "App") and related services (collectively, the "Service") operated by LetsLink LLC ("LETSLINK," "we," "us," or "our"), a company organized under the laws of the State of Illinois, with offices located in Chicago, Illinois.

By downloading, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

1. Eligibility

1.1 You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you are at least 18 years of age.

1.2 By agreeing to these Terms, you represent and warrant that you have the legal capacity to enter into a binding agreement.

2. Account Registration

2.1 To use certain features of the Service, you must register for an account by providing accurate and complete information, including your name, email address, and date of birth.

2.2 You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

2.3 You agree to notify us immediately of any unauthorized use of your account.

2.4 We reserve the right to suspend or terminate your account at our discretion if we believe you have violated these Terms.

3. Use of the Service

3.1 The Service is a peer-to-peer marketplace that allows users to list, browse, and purchase secondhand clothing and accessories through in-person transactions.

3.2 Sellers may list items for sale by providing descriptions, photos, and pricing. All listings must comply with our Prohibited Items policy (see Section 4).

3.3 Buyers may browse listings, communicate with sellers, and initiate purchases through the App.

Payment Processing

3.4 All payments are processed through Stripe, our third-party payment processor. By using the payment features of the Service, you also agree to Stripe's Terms of Service and Privacy Policy.

3.5 When a buyer initiates a purchase, payment is held in escrow by Stripe until the transaction is completed through an in-person meetup and confirmed by both parties.

3.6 Sellers must set up a Stripe Connect account to receive payments. This requires identity verification and banking information, which is collected and managed directly by Stripe.

In-Person Transactions

3.7 All transactions are completed through in-person meetups between buyers and sellers. The Service facilitates these meetups by allowing users to share general location information.

3.8 Upon meeting, the buyer and seller confirm the transaction through the App using a verification PIN. Once confirmed, payment is released to the seller.

3.9 LETSLINK is not responsible for the conduct of users during in-person meetups. Users are encouraged to meet in safe, public locations.

3.10 Users should exercise reasonable caution when arranging and attending meetups. Meet in well-lit, public locations during daylight hours when possible. LETSLINK does not guarantee the safety of any meetup.

4. Prohibited Items and Conduct

4.1 The following items are prohibited from being listed on the Service:

  • Counterfeit or stolen goods
  • Items that violate any applicable law or regulation
  • Weapons, drugs, or other controlled substances
  • Items that infringe on intellectual property rights
  • Hazardous materials
  • Any non-clothing or non-accessory items (unless specifically permitted)

4.2 Users are prohibited from:

  • Providing false or misleading information in listings
  • Harassing, threatening, or intimidating other users
  • Attempting to circumvent the Service's payment system
  • Using the Service for any illegal purpose
  • Creating multiple accounts to evade restrictions
  • Manipulating reviews, ratings, or other feedback mechanisms

5. Fees and Payments

5.1 LETSLINK may charge service fees on transactions conducted through the Service. Current fee structures will be displayed within the App before any transaction is confirmed. Payments are processed by Stripe and subject to their Terms of Service.

5.2 All prices listed on the Service are in U.S. Dollars (USD) unless otherwise specified.

5.3 Refund policies are handled on a case-by-case basis. If a transaction dispute arises, users should contact us at support@letslink.co.

6. Intellectual Property

6.1 The Service, including its design, features, and content created by LETSLINK, is protected by copyright, trademark, and other intellectual property laws.

6.2 By posting content (such as photos and descriptions) on the Service, you grant LETSLINK a non-exclusive, worldwide, royalty-free license to use, display, and distribute such content in connection with operating and promoting the Service.

6.3 You retain ownership of any content you post, subject to the license granted in Section 6.2.

7. Privacy

7.1 Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

7.2 By using the Service, you consent to the collection and use of your information as described in the Privacy Policy.

8. Disclaimers

8.1 THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

8.2 LETSLINK does not guarantee the accuracy, completeness, or reliability of any content posted by users.

8.3 LETSLINK is not a party to transactions between users and is not responsible for the quality, safety, or legality of items listed on the Service.

9. Limitation of Liability

9.1 TO THE MAXIMUM EXTENT PERMITTED BY LAW, LETSLINK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

9.2 LETSLINK'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO LETSLINK IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify, defend, and hold harmless LETSLINK and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of another.

11. Dispute Resolution

11.1 Any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in Cook County, Illinois.

11.2 You agree to waive any right to a jury trial or to participate in a class action lawsuit.

11.3 Notwithstanding the foregoing, either party may seek injunctive or equitable relief in any court of competent jurisdiction.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law principles.

13. Changes to These Terms

13.1 We reserve the right to modify these Terms at any time. Changes will be effective when posted within the App.

13.2 Your continued use of the Service after changes are posted constitutes your acceptance of the modified Terms.

13.3 We will make reasonable efforts to notify users of material changes to these Terms.

14. Termination

14.1 You may terminate your account at any time by contacting us at support@letslink.co.

14.2 We may suspend or terminate your account at any time, with or without cause, and with or without notice.

14.3 Upon termination, your right to use the Service will immediately cease. Sections 6, 8, 9, 10, 11, and 12 shall survive termination.
